Employer and Employee Representation in Employment Law Matters
Maternity leave disputes are complex on many different levels. If you are involved in a conflict over maternity leave, seeking advice from a solicitor with a proven track record in employment law is in your best interests. At Waldegraves, we have the experience necessary to represent both employers and employees with vigorous advocacy.
Maternity Leave
Women are entitled to a certain amount of wages and time off when they have a child. Statutory Maternity Pay is for up to 52 weeks total. The first six weeks the employer pays 90 percent of the woman's normal salary, then for the next 33 weeks the employee is entitled to statutory maternity pay. This means it is paid by the government. That amount is either £128.73 or 90 percent of the woman's average weekly earnings. The remaining 13 weeks included in maternity leave are considered unpaid time off. However, some employers offer more generous plans.
There are various complex rules about providing notice to an employer. This includes notifying the employer in terms of the expected week of birth of the child, the date on which you intend to start maternity, etc. When you return, the terms and conditions of your employment contract must remain the same.
Maternity leave cases tend to be in conjunction with discrimination claims. It is automatically considered unfair to dismiss someone or discriminate against her because she has taken maternity leave. If you went on maternity leave and your wages were cut, you were fired or you were harassed, you are likely to have a legitimate case. We can help in any of these types of situations.
Parental Leave in the UK
Parental leave applies to parents of children under the age of 5. The parent may only be entitled to parental leave for up to 13 weeks of unpaid time off for each child up to his or her fifth birthday. If you are facing a dispute that involves parental leave or have questions, Waldegraves is ready to represent your interests.
